Terms of Service

The terms for creating an account, buying reports and subscriptions, and using the data in the reports.

This page is a translation for convenience. The Italian version is the legally binding text and prevails in case of any discrepancy.

These terms govern the use of Vicinalia, available at https://vicinalia.com, and the purchase of reports and subscriptions. By creating an account or completing a purchase you confirm that you have read and accepted them. We recommend you save a copy.

1. Who provides the service

The service is provided by Vicinalia.com, with registered office at via Pietro Custodi, 3, 20136 Milano (MI) (referred to below as "we" or "the provider"). Our full details are:

2. Definitions

  • User: anyone who uses the site, with or without an account.
  • Consumer: a natural person acting for purposes outside their trade, business, craft or profession.
  • Professional: a natural or legal person who uses the service as part of their business, for example estate agents, surveyors, notaries, banks and companies.
  • Report: the information document, viewable online and downloadable as a PDF, that the service generates about a property or land parcel.
  • Plan: the purchase option chosen (single report, subscription, professional plan), with the features shown on the Prices page at the time of purchase.

3. What the service is

Vicinalia generates information reports about a property or land parcel, starting from an address or cadastral details, by combining open data published by Italian and European bodies, such as the Revenue Agency, ISPRA, INGV, Istat, the Civil Protection Department, the European Commission, AGCOM, OpenStreetMap and Overture Maps. How we build the reports is explained on the Methodology page.

The report works at the level of the land parcel and the building, not the individual flat: sub-units and floor plans are not open data and are not included.

4. What the service is not

The report is not:

  • a survey or a valuation of the property: OMI valuations are a range of prices for the zone, not the value of a specific property;
  • a cadastral or land registry search, nor a document with legal or evidentiary value;
  • technical, planning, legal, tax or financial advice;
  • a substitute for official civil protection, hydrogeological risk or seismic classification plans.

For important decisions, such as buying a property, taking out a mortgage or building work, check the information with the relevant authorities and consult a qualified professional.

5. Sources, dates and data licences

Data comes from public sources with different update dates, coverage and accuracy. It may be incomplete, out of date, or contain errors from the sources themselves. Each report section states the source, licence and date of the data. The full list is on the Sources page.

Some data carries licences with specific obligations, for example the obligation to credit the source, the obligation to share derived works under the same terms (as with the CC BY-SA 4.0 licence for ISPRA data), or a ban on reselling the database (as with the Revenue Agency's OMI valuations). By using the reports you agree to comply with these licences.

6. Accounts

  • To create an account you must be at least 18 years old and provide true and up-to-date information.
  • Credentials are personal: do not share them and keep them safe. We recommend enabling two-factor authentication or a passkey.
  • You are responsible for what happens through your account, unless you can show unauthorised use that is not your fault. If you suspect unauthorised access, write to us straight away.
  • On the professional plan with multiple users, each person must have their own login. The plan holder is responsible for the use made by the users they authorise.

7. Permitted use of reports

You may use reports for your personal needs or for your professional activity. You may share a report's PDF with people involved in the same transaction, for example the other party to a sale or lease, your surveyor, the notary or the bank.

When you reuse or cite data contained in a report, you must keep the source and licence credits shown.

The exception is the content of report sections derived from data licensed under CC BY-SA 4.0: today the flooding section and the part of the landslide section taken from the IFFI inventory, both ISPRA data. That content is distributed under the same licence, as stated under the section: you may reuse and share it beyond the limits of this point, provided you credit the source and keep the same licence.

You may not:

  • extract data in bulk or systematically, including with scripts, bots or scraping of the site;
  • resell reports or the data they contain, or make them available to third parties in an organised way;
  • use reports or data to build competing databases, services or products;
  • circumvent plan limits, share accounts, or create multiple accounts to obtain free reports;
  • use the service unlawfully, to harass people, or to obtain information about specific owners;
  • compromise the security or operation of the site.

8. Plans, prices and payment

Plans, features, the number of reports included and prices are shown on the Prices page. Prices are shown with or without VAT as indicated on that page and in the summary before payment, which always shows the total amount due.

Payments are handled by Stripe, by card or with the other methods offered at the time of purchase. We issue the invoice based on the invoicing details you provide; you are responsible for their accuracy.

The contract is concluded when your payment goes through: straight afterwards we send you the purchase confirmation email.

9. Single report

When you buy a single report, you ask us to process the data for the property or parcel you have indicated and to generate the report straight away. The single report is paid for once and remains available in your personal area while your account is active.

10. Subscriptions

  • Length and payment: subscriptions last one year and are billed annually. The year starts when the subscription is activated: straight after payment or, if you are a consumer and do not ask for immediate activation, after 14 days (point 13). The monthly price shown on the Prices page is only there for comparison.
  • Reports included: each plan shows the reports included in the year and any maximum in a calendar month. Unused reports do not carry over to the following year.
  • Renewal: when you subscribe you choose automatic renewal (selected by default) or manual renewal, and you can change your choice from your personal area until the end of the subscription. With automatic renewal the subscription renews for another year and the price is charged to your registered payment method. With manual renewal the subscription ends on its expiry date, unless you renew it from your personal area.
  • Notice before expiry: about 15 days before the subscription ends we email you with the date, the amount and how to change your renewal choice or cancel.
  • Cancellation: you can cancel at any time from your personal area or by writing to [email protected]. Cancellation takes effect at the end of the year already paid for: until then you can keep using the service, and you do not receive a refund for the current period, except as provided for withdrawal (point 13) and the conformity guarantee (point 14).
  • Failed payment: if renewal fails we notify you by email. If payment is not brought up to date, the subscription may be suspended or closed; reports already generated remain accessible.
  • Changing plan: you can switch to another plan following the process shown in your personal area.
  • Promotions: a discount applies for the period stated in the offer (usually the first year only). The terms of each promotion are shown before payment.

11. Price changes

We may change prices. New prices apply immediately to new purchases. Existing subscribers keep the price they paid, including at renewal, until we notify them of a change by email at least 30 days before the renewal it applies to. If you do not accept the new price, you may cancel the subscription before that renewal, at no cost.

12. Free access

We may, at our discretion, grant free use of a plan to individual users, for example testers, partners or journalists. Free access has a monthly report limit and an expiry date, communicated to the recipient. We may revoke it at any time. It is provided as is, with no availability commitment, and does not entitle you to refunds or compensation. These terms otherwise apply.

13. Right of withdrawal for consumers

If you are a consumer, you may withdraw from the contract within 14 days of its conclusion, without giving a reason, as provided by Articles 52 et seq. of the Italian Consumer Code (Legislative Decree 206/2005). The right of withdrawal does not apply to purchases made with a VAT number or for your business or profession.

Single report. If you are a consumer, before payment we ask you to agree to the service being performed straight away and to acknowledge that, once the report is generated and available in your personal area, the service has been fully performed and you lose your right of withdrawal (Article 59(1)(a) of the Consumer Code). Reading the report online or downloading it as a PDF makes no difference: the service is complete when the report is available. We confirm your choice in the purchase confirmation email.

Subscriptions. The subscription is a digital service. When you subscribe you can expressly ask for it to be activated straight away, before the 14-day withdrawal period ends. If you do not ask, the subscription is activated when the 14 days are over; in the meantime you can ask for immediate activation from your personal area.

  • If you withdraw without having asked for immediate activation, we refund the full price.
  • If you asked for immediate activation, you only pay for the services already provided up to the moment you notify us of your withdrawal (Article 57(3) of the Consumer Code). Each report generated before that moment counts at the single report price in force when you subscribed, even if you did not download it as a PDF. The amount we keep never exceeds the price paid for the subscription. We refund the difference.

For example, if you pay 99 euros for a subscription and generate 2 reports when the single report costs 14.90 euros, we keep 29.80 euros and refund 69.20 euros.

Withdrawal applies to the first purchase of the subscription, not to later renewals.

How to withdraw. The easiest way is the subscription page in your personal area: while you are within the 14 days you will find the button to request withdrawal, with the reports generated and the expected refund. Alternatively, before the deadline, send an explicit statement to [email protected], stating your name, account email, purchase and date. You may also use this form:

Checks and refund. We check every request, for example that it arrived within the 14 days and that the purchase was made as a consumer, and we email you the outcome: a full refund, a partial refund with the calculation, or the reason why withdrawal is not possible. While we check the request you cannot generate new reports with the subscription. Withdrawal closes the subscription. We refund what is owed within 14 days of the day we receive your withdrawal notice, using the same payment method, at no cost to you.

14. Conformity guarantee

If you are a consumer, you are entitled to the statutory conformity guarantee for digital content and services under Articles 135-octies et seq. of the Consumer Code. If a report or the service does not conform to what is described in these terms and on the Prices page, for example because a report fails to generate, is unreadable, or does not match the property requested, write to us at [email protected]. We will restore conformity at no cost within a reasonable time; if that is not possible, you are entitled to a price reduction or termination of the contract with a refund, in the cases provided by law.

The limits of public data described in points 4 and 5, such as update dates, partial coverage or data not available in some areas, do not constitute a lack of conformity when they are stated in the report.

15. Service availability

We do our best to keep the service available and working, but we cannot guarantee it will always be accessible or error-free. The service may be suspended for maintenance, updates, or problems with providers or public sources. Where possible, we give advance notice of planned maintenance. Some data may not be available in some areas, for example where a source does not publish it there.

16. Suspension and closure of accounts

We may suspend or close an account, having warned you where possible, if you breach these terms, in particular point 7, if there are concrete signs of fraud or misuse, or if required by an authority. In serious cases we may suspend the account immediately. If closure results from your breach, no refund is due for periods already paid, subject to consumers' mandatory rights.

You can close your account at any time by writing to [email protected]. Closure does not entitle you to a refund of periods already paid, except as provided in points 13 and 14.

17. Liability

We are liable for the proper functioning of the service as required by law. In particular:

  • the accuracy and currency of data depends on public sources: we are not liable for errors, omissions or delays in the sources, when we have reported them correctly and with the source and date shown;
  • we are not liable for decisions taken based solely on the report, without the checks described in point 4;
  • towards professionals, our liability for damages is limited to the amount paid in the 12 months preceding the event that caused the damage, and excludes indirect damages, such as loss of profit or loss of opportunity.

These limitations do not apply in cases of wilful misconduct or gross negligence, personal injury, or other cases where the law does not allow liability to be limited. Nothing in these terms limits the rights the Consumer Code grants to consumers.

18. Intellectual property

The software, text, graphics, report layout, and the name and trademark Vicinalia belong to the provider or its licensors and are protected by law. Your purchase gives you the right to use reports as described in point 7, not ownership of the software or content.

Source data remains subject to its own licences, shown in the report and on the Sources page. The content of report sections derived from data licensed under CC BY-SA 4.0 is distributed under the same licence, as set out in point 7 and under the section.

19. API for professionals

With the plans that include it you can use the API to create and read reports from your own software. Access is not automatic: you request it from your account, explaining the intended use, and it starts only after our approval, which we may refuse. Access uses personal tokens created in your account: they work like a password, must not be shared and you can revoke them at any time. The same report limits as your plan apply, together with a limit on requests per minute and the prohibitions in point 7. We may suspend access, or a token, used abnormally or putting the service at risk.

20. Changes to these terms

We may change these terms for reasons linked to changes in the service, sources, regulations or providers. The version in force is always published on this page with its update date. Purchases already concluded remain governed by the terms in force at the time of purchase.

For subscribers, we notify significant changes by email at least 30 days in advance. If you do not accept them, you may cancel your subscription before they take effect, at no cost. Changes required by law may take effect immediately.

21. Personal data

We process personal data as described in the Privacy Policy and the Cookie Policy.

22. Governing law and jurisdiction

These terms are governed by Italian law. If you are a consumer, any more favourable mandatory provisions of the country where you habitually reside remain unaffected, where applicable.

For disputes with consumers, the court of the consumer's place of residence or domicile, if located in Italy, has exclusive jurisdiction, as provided by Article 66-bis of the Consumer Code. For disputes with professionals, the court of the place where the provider has its registered office has exclusive jurisdiction.

23. Complaints and alternative dispute resolution

For any complaint, write to [email protected]: we respond within 30 days.

If you are a consumer and are not satisfied with our response, you may refer the matter to an alternative dispute resolution (ADR) body listed under Articles 141 et seq. of the Consumer Code. Using these procedures is optional and does not prevent you from going to court.
